GENERAL

These general conditions of sale (CGV) apply, without restriction or reservation, to all services (hereinafter the “Services”) offered by “Massages O Top”, an individual company registered by Audrey Renaud under the SIRET number 841 834 831 00015 in Lamorlaye, to all of its customers, whatever their status or quality.

Consequently, the placing of an order by a customer for the performance of a Service offered on the massagesotop.com website after reading the different massage techniques, the General Terms and Conditions of the Massagesotop.com website; as well as the law on the GDPR entails the support of the latter and their acceptance, without reservation, unless specific agreement previously agreed in writing between the parties.

These are manual techniques for well-being and relaxation only.

All services of an erotic or sexual nature are also excluded from the “o top massages” activity. Any inappropriate behavior towards Audrey Renaud will put an end to the service and may be subject to legal action.

CONDITIONS FOR PROVIDING WELL-BEING MASSAGE SERVICES, MANUAL TECHNIQUES, WELL-BEING SERVICES (sauna, etc.)

“Massages o top” only works by appointment at its salon, at the client's home under certain conditions (mileage costs and payment before the start of the service), and under contract, for professional environments, in educational or leisure settings , in health establishments (hospitals, clinics, retirement homes, etc.), or in all places open to the public (event settings, trade fairs, congresses, etc.).

If it is impossible to carry out the Services at a client's home, “Massages O Top” reserves the right to offer the desired well-being massage to the address of the massage parlor o top.

The Services are offered from Monday to Sunday afternoon and certain evenings, closed on Wednesday, at the times mentioned on the site, these can be modified by the company according to need.

For home services, the client undertakes to provide “Massages O Top” with a work space of at least 10 m2 and whose conditions of hygiene, calm and safety are compatible with the carrying out of a massage.

During wellness massage sessions in the salon or at home, “Massages O Top” provides the client with all the necessary professional equipment (massage table, protective linen, towels, massage oils, accompanying music, hygienic products).

The duration of the massages indicated on the website does not take into account the time spent dressing and undressing, which is why it is recommended to allow an additional 30 minutes in addition to the time indicated for the massage.

It is strongly recommended to be punctual for your appointment, otherwise your session will be shortened so as not to postpone the next appointment.

Beyond 30 minutes, your appointment will be canceled and the reservation fees will be non-refundable as indicated in the General Terms and Conditions paragraph 5.2.

There is no point in being too early because you would have to wait for your appointment time, as the salon does not have a waiting room.

 

CONTRAINDICATIONS TO WELL-BEING MASSAGE SERVICES, MANUAL TECHNIQUES, WELL-BEING SERVICES (sauna, etc.)

Each client must comply with the advice and recommendations of “Massages o top” particularly regarding contraindications to wellness massages.

Indeed, upon reading these General Terms and Conditions, the customer is informed and accepts that it is contraindicated to give a wellness massage, without prior medical advice, to suffering people, without this list being exhaustive, serious pathologies (heart problems, kidney failure, cancer, fever, pregnancy, etc.), nervous disorders (epilepsy, bipolar disorders, schizophrenia, etc.), significant diabetes, and contagious or oozing skin problems.

There are absolute contraindications:

Phlebitis (even recent), high fever, on a fibroid or tumor, during chemotherapy, following major surgery and less than 3 months old.

 

Finally, there are restrictions relating to massage in the following cases (the areas concerned being prohibited):

Injury (acute inflammation such as sciatica, muscle tear, recent or painful scar, wound), significant circulatory disorder, tendinitis or dislocation, disc herniation, acute attack of osteoarthritis or arthritis, hematomas, covering skin conditions (edema, dermatosis, infected eczema) or contagious.

In the event of allergies, the client undertakes to inform “Massages O Top” when making the appointment.

In the event of a pregnancy greater than 3 months, it is recommended that the client seek prior advice from her doctor, gynecologist or midwife and inform “Massages O Top” when making an appointment.

To ensure that her client is able to receive a wellness massage, Audrey Renaud will ask her client during the first appointment that none of the contraindications cited above are incompatible.

 

The client who certifies that he has nothing to declare about his state of health which would not be compatible with carrying out a well-being massage on his person without medical advice, remains solely responsible in the event of non-compliance. of these contraindications and must inform Audrey Renaud in advance of any changes in her state of health during future appointments.

 

Consequently, “Massages O Top” reserves the right to refuse at any time a client whose state of health is not compatible with carrying out a wellness massage on their person without prior medical advice.

Likewise, massage sessions will only be offered to adults, or minors holding authorization from their legal representative to practice wellness massage.

Acknowledgment and acceptance of these General Terms and Conditions must be read and accepted by the future customer before any reservation.

 

FINANCIAL CONDITIONS

The prices of the Services offered are indicated in euros on the website www.massagesotop.com, at LES MASSAGES.

“Massages O Top” is not subject to Value Added Tax (VAT) in accordance with article 293 B of the General Tax Code, the prices mentioned on the website are therefore indicated without VAT.

In the event that “Massages O Top” becomes subject to VAT, the prices displayed on the site will be readjusted accordingly and applicable to any order placed following the date of its subjection.

“Massages o top” also reserves the right to modify its prices at any time, it being specified that the Services will be invoiced on the basis of the rates in force at the time of booking the appointment.

SERVICES WITH PERSONALIZED QUOTES

The quote and the T&Cs signed by the customer constitute agreement and order form.

The quote and signed T&Cs must be accompanied by a payment of 30% of the total amount indicated on the quote.

Unless an additional payment deadline is agreed between the two parties and appears on the invoice, the balance of payment is made in cash within a maximum period of 15 (fifteen) days following the date of issue of the invoice, by check or bank transfer.

 

In the event of late payment, a penalty set at 15% of the invoice amount, per month of delay initiated, is payable without a reminder being necessary, from the day following the payment deadline.

 

Any request for postponement or cancellation by the client must reach “Massages O Top” at least 15 (fifteen) working days before the fixed date. Failing this, “Massages O Top” will be entitled to invoice, as compensation, 50% (fifty) percent of the total amount of the invoice, before deduction of the deposit received.

 

If the cancellation occurs within 7 (seven) working days before the fixed date, “Massages O Top” will be entitled to invoice, as compensation, 75% (seventy-five) percent of the total amount of the cancellation. invoice, before deduction of the deposit received.

REGISTERED CUSTOMER

The customer has the option either to make their appointment directly on the online site massagesotop.com or to call/send an SMS to Massages O top specifying:

With or without Essential oils.

An appointment confirmation SMS will be sent.

Otherwise, a message from the company will be sent if the chosen time is not possible to arrange another day/time.

The payment invoice will be sent upon receipt of confirmation of the appointment made.

 

DELAYS TO AN APPOINTMENT DELAY LESS THAN 30 MINUTES

The customer will be received but the service will be shortened by a duration equal to the delay, in order not to delay the next appointment.

 

DELAY MORE THAN 30 MINUTES

For any delay of more than 30 minutes, the non-compliance with consideration clauses apply and the customer will not be able to be received by the company to benefit from its care which cannot be qualitative.

 

CANCELLATION OF APPOINTMENT

CANCELLATION OR POSTPONEMENT OF APPOINTMENT

DURATION / VALIDITY:

The chosen package is subscribed for a specific period of time.

The package is valid for annual packages: 12 calendar months or 3 months for SLIMMING packages on the departure date which corresponds to the payment.

 

ACCEPTANCE OF THE PACKAGE

The member's acceptance of a package purchase constitutes a firm commitment and acceptance of these General Conditions of Sale of the company and all its related clauses.

If you do not agree with these, do not subscribe to a package.

 

PRICING – PAYMENT TERMS:

The pricing of the packages corresponds to massages which can be sold individually but which, thanks to a multiple purchase, benefit from a constant annual promotional reduction.

Massages will be deducted from the Package purchased.

Your massage credit only takes into account prices excluding short-term promotions offered occasionally.

All promotions carried out during the year cannot be combined or interfere with the price of the PACKAGES.

Subscriptions can be paid in several installments after agreement with management.

The payment facilities in cash, transfers and credit cards at the salon require a limited number of services until full payment of the chosen package.

Management fees apply for payment facilities which mainly correspond to processing fees by credit card and cash payment services which are deducted by the company's financial establishments at each request.

The sessions can begin directly upon payment of the package.

The choice of a payment facility settled in cash gives the right to the immediate start of the sessions of the chosen package.

Each due payment entitles you to the number of massages defined by the chosen package.

 

BY credit card

BY CHECKS

Checks must be issued and given to massages o top in advance in one go by the customer and for the number of deadlines chosen.

Each check will be cashed each month on the date the customer chooses between the 5th, 10th or 15th of the month.

In the event of a check being bounced, the customer can settle the incident by credit card, transfer or cash.

This method of payment change will apply its own terms and conditions (CB & Cash).

Otherwise, the massage sessions will be canceled and the package will be void.

CANCELLATION-DELAY

Any appointment not canceled within the allotted time (2 hours) or delay exceeding 30 minutes, the session will be deducted from the package and will neither be refunded nor eligible for a postponement of the appointment.

 

TERMINATION

By the company:

Non-compliance with the conditions, bad behavior, cases of fraud, falsification, false declaration or non-payment, will result in termination of the package without the member being able to claim financial compensation.

By the customer :

The customer has 14 days from the date of collection by the credit card or check company to cancel their package and be reimbursed without having to provide a reason.

A simple letter requesting reimbursement is requested as proof of the company's accounting year.

Any package started will not be eligible for any refund, even partial, and constitutes acceptance of it in its entirety.

The customer who subscribes to a package cannot claim any modification or refund of his package if its validity has expired.

 

NO USE OF THE SUBSCRIPTION:

If the member does not use the subscription taken out for any reason not involving the responsibility of Massages O Top (sick leave, etc.), he or she cannot claim any reimbursement or exchange if it has exceeded the 14 days after receipt of financial payment for a package.

ESSENTIAL OILS

High quality, organic essential oils. (Essential Earth, Weleda, Aroma zone, Florame, Naturalia...) can be added if desired in order to perfect the effect of the well-being massage with a supplement of €10.

Various Formulas (established by an Aromatherapist who composed these Formulas which constitute the strongest reactivity according to the desired effect are suitable for people not sensitive to Essential oils.

If in doubt, do not have a massage with Essential Oils, just with sweet almond oil or coconut oil.

Massages O Top cannot be held responsible in the event of non-compliance with these recommendations.

18 INABILITY TO WORK

In the event of temporary physical incapacity, due to illness or accident of Audrey Renaud, “Massages o Top” reserves the right to reschedule new dates of interventions in consultation with the client without it being possible to be required by the latter to pay compensation.

In the event of permanent physical incapacity of the practitioner, any type of contract or commitment with clients of “Massages o top” will be terminated automatically without compensation being claimed from “Massages O Top”. . Deposits/payments received will be returned to the client within a maximum period of 30 (thirty) days following termination of the contract and in proportion to the sessions already carried out.

 

APPLICABLE LAW AND COMPETENT JURISDICTION

These General Terms and Conditions are subject to French legislation.

In the event of disputes, the parties undertake to seek an amicable solution before any legal action between the parties or via a mediator.
